In a win for Oregon, judges from the Ninth Circuit Court of Appeals will rehear the Trump administration's appeal of an order preventing deployment of the Oregon National Guard to Portland, the court announced Oct. 28.
The decision vacates a 2-1 ruling issued Oct. 20 in which appeals judges determined Oregon National Guard members could be federalized and deployed.
A group of 11 judges will consider the appeal "en banc," a rare review process where the three appeals judges' initial decision is voided and the larger group will make a determination.
