FAIRMONT — Defense Attorney Elgine McArdle planned to argue that the Marion County Prosecuting Attorney engaged in misconduct against her client, Ryan Lane, in Marion County Circuit Court Tuesday morning.

Instead, the Marion County Prosecuting Attorney's Office had a misdemeanor criminal complaint waiting for her at the courthouse.
