A ruling by U.S. District Court Judge Cameron McGowan Currie has some legal experts “scratching their heads” as it appears to be putting newly-appointed U.S. Attorney Lindsay Halligan in the position for a face-to-face smack-down next Monday.
That is the opinion of former litigator and current MSNBC legal analyst Lisa Rubin, who claimed there is more than enough evidence for the judge to dismiss the case against New York Attorney General Letitia James for bank fraud out of hand, but she is holding off until Monday where she will take up both the James case and the indictment of former FBI Director James Comey.
Appearing on “Morning Joe,” Rubin stated, “Judge Currie does seem skeptical, but she issued an order in both cases yesterday that has some people scratching their heads as well. And here's what she's asking for: she's telling the government, by Monday at 5 P.M. which is not, coincidentally, the day on which they have to respond to these motions to dismiss the indictments because of Lindsay Halligan, you also have to give me all evidence of Lindsey Halligan's involvement in the grand jury proceedings affecting both Tish James and Jim Comey.”
“Now, there are some people who look at this and say, this should be an open and shut issue. Lindsey Halligan signed both indictments; by all accounts and reporting, she's the only person in the room,” she added.
“The judge knows, this right? “ co-host Joe Scarborough interrupted, “Sounds like a set-up.”
"Well, I think part of it,” Rubin conceded.
“I'm not saying in any bad way,” Scarborough added. “I'm saying she's, you know, she knows the answer, but she wants Lindsey Halligan to say it. Well, it was just me.”
“Well, maybe just exactly that,“ the legal expert agreed. “Which is to say, if you know where this is headed from a legal perspective, maybe you want to shore up your legal analysis with more evidence so that you can say, ‘I'm not just relying on public reporting.’ But I know now, on the basis of these grand jury transcripts, that she was the only person in the room. And I can see from the face of both indictments that she is the only one to have signed it.”
