MEMPHIS, Tenn. -- The United States Attorney has filed an "emergency motion" to block the release of Lindsey Whiteside from jail, according to court documents.

Whiteside is facing federal charges for allegedly transporting a minor across state lines to commit sex crimes.

"The United States requests that this court uphold the presumption, find Lindsey Aldy Whiteside to be a danger to other persons and the community by clear and convincing evidence, and order the defendant detained pending trial," The US attorney said. "Whiteside is a convicted sex offender."

Documents also say the rebuttable presumption shifts to the defendant the burden of producing evidence that the defendant is not a danger to the community.

This comes after a federal judge imposed a restrictive 24-hour house arrest
