A Delhi court on Friday discharged former coal ministry officials H C Gupta (secretary), K S Kropha (joint secretary), as well as a company and its Director and Managing Director in a case linked to alleged irregularities in the allocation of the Fatehpur East coal block in Chhattisgarh to the company — M/s R.K.M. Powergen Pvt. Ltd — by the Ministry of Coal.
“There is not even an iota of material available on record to suggest that the act of accused public servants (Kropha and Gupta) was without public interest,” said Special Judge Dheeraj Mor of Rouse Avenue Court in an order dated October 31.
“… irregularities in absence of any established mens rea or dishonest intention cannot be given the tone of criminality,” he added, while discharging the former officials.
