COLUMBUS, Ohio — If a lawsuit were filed to challenge Cleveland State University’s deal with Ideastream over WCSB 89.3, lawyers could subpoena participants of an Aug. 7 closed-door meeting and depose them to learn exactly what was discussed, a longtime Cleveland attorney said.

“In my experience, what I would do, I’d sue these guys and I would depose everybody I could depose,” said lawyer David Marburger, who drafted a revision to Ohio’s public records law. “And this would be expensive. I’d find out what happened in that executive session. And I’d find out what did happen in there. I would use subpoena power to impeach the claim, the reason for this executive session.”
