“The circumstances of this application are highly unusual,” Justice Dawn Pentelechuk wrote for the Court of Appeal .

The case stems back to when Zawadiuk crashed the vehicle into the building and then vandalized the indoors with racist graffiti, according to the court. Zawadiuk was “in a methamphetamine-induced psychosis” at the time, Pentelechuk wrote.
