The man who was captured in a viral video attacking a 14-year-old boy riding his bike in a neighborhood last year will avoid additional jail time.
Jason Harrell, 46, agreed to plead guilty to two felony counts of intimidation, one misdemeanor count of intimidation, and two counts of battery.
Prosecutors asked Marion County Judge William J. Nelson to consider a stiffer sentence based on multiple factors, including the "hate crime aggravator" for comments made by Harrell toward the boy.
"When I watch that video, I see a young man being respectful and brave in the face of abhorrent behavior by someone who is supposed to be an adult," Marion County Prosecutor Ryan Mears said in an emailed statement.
