BISMARCK, ND (KXNET) — The Standing Rock Sioux Tribe filed an appeal Nov. 5 challenging what it calls the illegal operation of the Dakota Access Pipeline, which runs a half-mile north of the tribe’s reservation and across lands protected by treaty.

The 1,174-mile pipeline carries Bakken crude oil from North Dakota to Illinois. The tribe argues the pipeline has operated without a valid environmental impact statement since 2020 and violates federal laws, including the Mineral Leasing Act and the Clean Water Act.

The appeal follows a federal court ruling on Oct. 14, 2024, that allowed the pipeline to continue operating without an easement the tribe says was never legally granted. The U.S. Army Corps of Engineers has permitted the pipeline to run under what the tribe calls an inadequate spil
