The Special Investigations Unit (SIU) is terminating its investigation into a serious injury a Kitchener man suffered while held in custody, due to a lack of jurisdiction.

The SIU have concluded a two-month long investigation after it was determined that the area where a 40-year-old Kitchener man was injured was only staffed by special constables and not police officers.

The man, held at the Waterloo Region Courthouse, suffered a serious injury that required him to be airlifted to a Toronto hospital.

The SIU said the man was arrested on Aug. 27 and held for a bail hearing following a report of a man fitting his description stealing ice cream from a business earlier that day, and the discovery of an outstanding unendorsed bench warrant.
