LOUISVILLE, Ky. (WAVE) - The United States Department of Justice is asking that former LMPD officer Brett Hankison be released from prison as he appeals his 33-month sentence for his role in the botched raid that ended the life of Breonna Taylor.

Earlier this year, DOJ attorneys recommended that Hankison serve only one day in prison. However, the recommendation was rejected by the judge, who said the recommendation inappropriate, and sentenced Hankison to 33 months in federal prison.
In an appeal filed on Nov. 14, a DOJ attorney argued that Hankison is not a flight risk or a danger to the public. The attorney also said that Hankison’s appeal could lead to a “reversal, a new trial, or a substantially reduced sentence.”
