Ghislaine Maxwell’s attorney is blasting Maryland Rep. Jamie Raskin, saying he “improperly” released her privileged prison emails in a move she calls “shocking” and unconstitutional.
In a statement issued Friday, Nov. 14, attorney Leah Saffian criticized Raskin — a Democrat from Maryland and Ranking Member of the House Oversight Committee — for providing Maxwell’s email correspondence to the media.
Saffian said the emails, which were sent through the Federal Bureau of Prisons’ monitored system, were “illegally obtained” and shared with a federal official who then released them publicly.
According to Saffian, “The release to the media by Congressman Raskin, of Ms Maxwell’s privileged client-attorney email correspondence with me is as improper as it is a denial of justice.”
She added that Raskin, who is both an attorney and a former law professor, “must be aware that his conduct undermines the whole legal process,” calling it a matter that “should be” referred for professional discipline.
Saffian said the emails were accessed by employees at Federal Prison Camp Bryan who “have been terminated for improper, unauthorized access” to the system.
She argued that providing those emails to Raskin, and his decision to make them public, breached Maxwell’s First, Sixth, and Fourteenth Amendment rights.
“Dressing the improper action up as ‘Whistleblower Information’ does not mitigate the fact that the emails were both illegally obtained and put to an unconstitutional purpose,” she wrote.
Saffian accused Raskin of seeking to “make political capital” from the release, calling it “shocking and reprehensible.”
The attorney also pushed back on Raskin’s claim that Maxwell was seeking a commutation or pardon from former President Donald Trump’s second administration.
“Contrary to Rep. Raskin’s assertion, Ms Maxwell has not requested a commutation or made a pardon application,” she wrote.
Saffian said Maxwell is preparing a habeas petition in federal court, which she says includes “material evidence not available” at the time of Maxwell’s 2021 trial and allegations of “government and juror misconduct.”
“It shows that Ms Maxwell has every right to expect rapid and meaningful relief from the court,” the attorney wrote.
"It also demonstrates unequivocally that significant government – and juror - misconduct occurred pre-, during and post-trial, making the verdict at the very least unsafe."
Raskin has not yet publicly responded to the statement.
