PORTLAND Ore. (KPTV) - The Trump administration has filed an appeal with the Ninth Circuit Court asking to pause a federal judge’s decision that blocked National Guard deployment to Portland.
The administration filed the emergency motion Sunday, seeking to overturn Judge Karin Immergut’s ruling that declared the troop deployment illegal.
Immergut made her ruling following a three-day trial earlier this month.
In her decision, Judge Immergut, who was appointed by Trump to her position in 2019, wrote that:
“Defendants’ deployment of unlawfully federalized National Guard troops to Oregon also violated the Tenth Amendment. Under the Tenth Amendment, ‘[t]he powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respect
