A truck driver involved in the crash that killed an Indiana National Guard soldier is being detained by ICE, according to Boone County law enforcement — prompting U.S. Sen. Jim Banks to decry his presence in the United States.

The soldier's family took exception with Banks' social media post, accusing the Indiana Republican of using the tragedy as a "political prop" in a statement to WTHR-TV.
