"Momentous" decisions will be made when courts resolve a lawsuit challenging the constitutionality of Arkansas' Educational Freedom Account Program, an attorney arguing on behalf of program participants told the state's highest court Thursday.

Joe Gay, an attorney with the Virginia-based Institute for Justice, made his case in oral arguments before the Arkansas Supreme Court, attempting to convince justices to overturn a July 24 circuit court ruling that denied his clients' request to intervene in the lawsuit. Richard Mays, the attorney for the plaintiffs in the original case that seeks to halt the account program, meanwhile argued the Gay's clients don't have sufficient grounds to do so. The court did not immediately rule on the request.
