Essex County prosecutors urged the full bench of the Supreme Judicial Court to keep Kelsey Fitzsimmons in jail, arguing that a lower court judge who ordered the 29-year-old police officer be jailed did not abuse her discretion or make an error of law.
Fitzsimmons, a North Andover police officer, is accused of aiming a gun at a fellow officer serving her a restraining order obtained by her fiancé on June 30. She denies aiming the gun at the officer who shot her in the chest, and has claimed she attempted suicide .
In September, Fitzsimmons was sent to jail after a superior court judge reversed a previous order that had allowed her release on conditions . The judge did so after Fitzsimmons’ lawyers said she couldn’t complete court-ordered alcohol testing without pain. Since t
