NEW YORK — Costco Wholesale filed a lawsuit against the Trump administration on Nov. 28, 2025, seeking a full refund of tariffs it says were unlawfully imposed on imported goods. The case, lodged in the U.S. Court of International Trade, challenges the legality of duties enacted under the International Emergency Economic Powers Act (IEEPA).
The retailer argues that Congress, not the president, has authority to levy tariffs and claims the administration overstepped by using emergency powers to justify sweeping trade measures. Costco’s filing asserts that the tariffs collected under Trump’s executive orders should be deemed invalid and the company should be reimbursed for payments already made.
Costco’s lawsuit comes as the Supreme Court reviews whether Trump’s tariff program can stand.
