CANTON, Ohio — The mother of Zachary Fornash, the 24-year-old who was two years ago, has filed a federal lawsuit against Marino as well as the city and other members of the police department.
The lawsuit, filed by DiCello Levitt, seeks a jury trial and a judgment of at least $1 million. It also calls for the Canton Police Department to adopt "an appropriate policy to prevent future instances of the type of misconduct" alleged in the lawsuit.
In addition to Marino, the lawsuit names the city of Canton as a defendant along with Police Chief John Gabbard and Sgt. Michael Rastetter, Marino's direct supervisor.
