SPRINGFIELD — A man suing Big Tobacco is asking a federal court judge to determine whether he is entitled to $5 million in relief, recent court documents show.

Juan Cotto, who first filed a suit against major tobacco manufacturers and cigarette retailers in August in state court, alleges the companies were negligent and fraudulently misrepresented cigarettes’ addictive nature.

R.J. Reynolds Tobacco Co., Philip Morris USA Inc., Liggett Group LLC — manufacturers of Marlboro and Winston cigarettes — and their retailers, Cumberland Farms of Massachusetts LLC and Walgreens of Massachusetts Inc., are named as defendants.

Cotto was diagnosed with stage 4 non-small cell lung cancer in 2022 after smoking cigarettes for 40 years, starting at 15, court documents said.
