LINCOLN, Neb. —

The man accused in a deadly shooting near the State Capitol plans to plead not responsible by reason of insanity.

Jacob Mulloy is charged with first-degree murder in the death of 52-year-old John Armstrong .

According to court documents, the state is asking for a court-ordered examination.

Previous coverage:

A criminal affidavit alleges that Mulloy and Armstrong had known each other for a few years.

The affidavit states that Mulloy told police they got into a fight inside his apartment Tuesday afternoon.

Mulloy alleges that Armstrong pushed him, knocking him to the ground, and threatened to beat him, according to court documents.

That's when Mulloy says he fired a single shot, hitting Armstrong in the head. He died at the scene.
