The legal battle between the City of Flagstaff and Desert Mountain Energy, a company hoping to drill for helium in the nearby Holbrook Basin, could be revived if a judge grants the city’s latest motion.
Attorneys for the city have asked Judge Charles Doughty of the Coconino County Superior Court for permission to file a second amended complaint in the case. The city’s original claims were declared “null and void” earlier this year by the Arizona Court of Appeals, which ruled that the Flagstaff City Council had failed to follow open meeting law when it authorized the lawsuit in 2020.
