Bruna Caroline Ferreira was arrested in Massachusetts on Nov. 12, and her attorney told ABC News that she will be released on Dec. 8 or 9

A Department of Homeland Security spokesperson previously told PEOPLE that Ferreira's tourist had visa expired in 1999 and alleged that she "has a previous arrest for battery"
