HENRY COUNTY, Ga. — The Georgia Supreme Court has revived a felony murder charge against five police officers accused in the 2019 death of Fernando Rodriguez, a 24-year-old man who died after being restrained by officers who responded to a disturbance call.
In a unanimous decision issued this week , the state's high court vacated a Henry County Superior Court ruling that had dismissed one of the murder counts against the officers.
Court records show what's known as a general demurrer - or challenge to the indictment - was granted on one count in September 2024. That has now been vacated and the case returns to the trial court for further proceedings.
