In a technically worded ruling that focused on how the Montana Legislature allocates money, a Lewis and Clark County District Court judge struck down a law passed in 2023 that created an education savings account for students with disabilities who wanted to utilize the program.

Opponents to House Bill 393 argued that the law that could set up a private education paid for with state funding was illegal, unconstitutional and only served to starve taxpayer resources from already cash-strapped districts.
