SPRINGFIELD, Ill. (WTVO) — The Department of Justice has filed a lawsuit against Illinois, challenging the state's in-state tuition policies under the RISE Act.

The lawsuit, filed by the DOJ, argues that Illinois's RISE Act, which was signed into law in 2019, violates federal law by providing state financial aid to undocumented students without offering the same benefits to out-of-state students.

The RISE Act allows undocumented students in Illinois to receive state financial aid, a benefit they are ineligible for at the federal level.

The DOJ contends that federal law prohibits states from offering such aid to undocumented students unless equal benefits are extended to all students, including those from out of state.
