PORTLAND Ore. (KPTV) - A 49-year-old man appeared in federal court on Monday after prosecutors say he was flying a drone near the Portland ICE facility and spit on a federal officer.

The U.S. Department of Justice says Devin Montgomery, 49, was told to stop flying a drone near the ICE facility in South Portland on September 4 because of flight restrictions issued by the Federal Aviation Administration.

Montgomery refused to stop flying the drone, and began cursing at federal officers who approached him, according to prosecutors.

After Montgomery was arrested, he allegedly spit in a federal officer’s face.

Montgomery has been charged with felony assault of a federal officer, and could face up to eight years in federal prison.
