A former Air Canada employee has dropped his lawsuit against the airline in which he alleged that he was unfairly criticized by a female manager for taking time off to be with his wife after she lost her baby during pregnancy, telling the plaintiff, “You are not the one who had the miscarriage.”

Luis Erick Escamilla Menjivar’s Los Angeles Superior Court lawsuit also alleged he was wrongfully fired in 2022 on a false accusation of poor attendance. On Monday, his attorneys filed court papers with Judge Lia Martin asking that Menjivar’s case be dismissed “with prejudice,” meaning it cannot be refiled.

The court papers do not state if a settlement was reached or if Menjivar is not pursuing the case for other reasons.
