Federal prosecutors are asking a judge to restrict the sorts of arguments Ward 8 Councilmember Trayon White can make in defense of his bribery charges.

In a motion filed Sept. 8, Assistant U.S. Attorney Joshua Gold argues that White should not be allowed to argue, as he has in some public statements, that he was entrapped by law enforcement; nor should he be allowed to introduce evidence that could encourage jury nullification.

Gold notes multiple instances in which White has claimed that the FBI set him up. While the D.C. Council voted to expel him in February, for example, a box truck sat outside the Wilson Building featuring a photo of White with the caption, “FBI SET ME UP”; White also wore a T-shirt during that hearing with the words, “THE FBI KILLED FRED HAMPTON.”
