The first punch has been thrown in what’s shaping up to be a brawl between two well-respected global companies, one of them headquartered in northeast Indiana.

A $69 million contract between Zimmer Biomet Holdings and Deloitte Consulting went terribly wrong last year, ballooning to $94 million, a “shocking” amount that was 36% more than the agreed-upon price for an enterprise resource planning software system, according to a court filing.

Zimmer Biomet says in the lawsuit filed in Supreme Court of the State of New York that the system was “wholly defective” and installed by Deloitte workers who were “incompetent and unqualified” for the task. The plaintiff alleges breach of contract and asks for more than $100 million in damages and attorneys’ fees.
