On Monday, the U.S. Supreme Court issued a decision that should shame every American who values equal justice under law. A concurring opinion written by Justice Brett Kavanaugh held that federal immigration agents are allowed to stop and question people on the basis of how they look, how they speak and where they work.
In one fell swoop, the court’s conservative majority affirmed the belief that a person’s legal status to exist within the nation’s borders can be called into question based on nothing more than the color of their skin, the language they speak, an accent, or their decision to visit or work at a place that law enforcement thinks might harbor undocumented immigrants.
