BISMARCK, N.D. (KFYR) - A federal appeals court ruled law enforcement was not liable for the 2017 death of a man on the Standing Rock Reservation.

The Eighth Circuit Court of Appeals affirmed an earlier ruling that law enforcement was justified in its use of deadly force against George Gipp Jr.

According to court documents, Bureau of Indian Affairs officers responded to a report that Gipp fired a gun at a gas station in Fort Yates.

The report states Gipp left the scene, but was pulled over later and found to be under the influence of multiple substances.

When officers tried to arrest him, investigators say he resisted and shook off two shots from an electronic shock device.
