Ball State University fired a staff member after she criticized conservative activist Charlie Kirk in a Facebook post that caught the attention of Attorney General Todd Rokita and national right-wing personalities .

The university said in a Sept. 17 statement that it terminated the employment of Suzanne Swierc, effective immediately, after it found her comments were "inconsistent with the distinctive nature and trust" of her role. She was Ball State's director of health promotion and advocacy.

The university also said her comments caused significant disruption to the college. A public institution can argue its right to fire an employee through a two-part test that considers whether an employee's speech disrupts the workplace.
