MEMPHIS, Tenn. -- Emmitt Martin, one of the officers who pleaded guilty to federal charges in the death of Tyre Nichols, is seeking release from prison until his sentencing.
Martin has been in custody since February after being accused of violating the conditions of his bail. His lawyers are revisiting an effort to secure his release, which was previously blocked in March.
Martin's attorneys argue that he should be released, citing "alleged bias" by Judge Norris, who recused himself from the case before sentencing.
His attorneys said Martin, like three officers who were granted a new trial, should be "released" or at least given a chance to "plead his case" for release until his sentencing.
