With a new tougher bail law in place, Gov. Kelly Ayotte said she’ll be reviewing records across the judicial system to confirm it is being followed and that dangerous offenders are kept from returning to the streets prior to a trial.
The reform began Sunday and it repealed a 2018 law and restored a lower “probable cause” standard that prosecutors must show to persuade a judge an offender should be held without bail.
For the past seven years, a suspect couldn’t be held unless there was “clear and convincing evidence” that he or she was a danger either to the public or themselves.
A former attorney general, Ayotte said the higher standard made it too easy for an offender to be released.
