JONESBORO, Ark. (KAIT) - A Memphis man accused of an early morning shooting last year no longer faces charges after the victim said he would not be “cooperative in the prosecution.”

On Wednesday, Sept. 24, Second Judicial Circuit Court Judge Chris Thyer signed an order of nolle prosequi in the case against Jessie James McDuffey III.

Deputy Prosecuting Attorney Jessica Thomason stated in the request that, despite Jonesboro police presenting “strong circumstantial evidence,” the victim “could not identify the defendant the night of the shooting,” and still cannot.

“The victim stated he had no restitution and will not be cooperative in the prosecution,” Thomason added.
