WINONA, Minn. - A lawyer for Jennifer Baechle, the woman charged with the death of a newborn baby in 2011, is asking the court to suppress certain evidence in the case.

In a motion filed on September 25th, Baechle's attorney calls into question the autopsy report on the infant. The lawyer claims missing information makes it difficult for the defense to refute evidence, thereby violating her rights to due process.

The attorney cites an autopsy report by the forensic pathologist, Dr. Lindsey Thomas, which stated it wasn't able to tell if the infant was born alive or stillborn. Charging documents stated a report from a pathologist showed the infant had head injuries that were sustained while it was alive.
