CLEVELAND (WJW) - A Cuyahoga County Common Pleas judge has granted a prosecutor's motion asking for a state mental health facility to turn over records showing a man accused of killing a Cleveland police officer is taking his prescribed medications.

Last September, Delawnte Hardy was ruled incompetent to stand trial. He was sent for inpatient treatment at Central Ohio Behavioral Health in Columbus in October of 2024.

The state has one year for Hardy to be restored to competency. If he is not found competent in a year, he could remain indefinitely institutionalized.

The judge recently extended the time for Hardy to be deemed competent to stand trial after learning Hardy delayed his treatment by failing to take his medicine for five months.
