BAKERSFIELD, Calif. (KGET) -- A motion has been filed seeking mental health diversion for former county supervisor Zack Scrivner. If granted, he may not serve a day in jail.

The motion, scheduled for a hearing Oct. 16, is under seal so specifics are unavailable.

But in cases where mental health diversion is granted, defendants undergo treatment and, if they fulfill all court-ordered requirements and stay out of trouble, are able to get their case dismissed.

It's unclear what mental health disorder Scrivner has. When he resigned from the Board of Supervisors last year, he cited "significant health and medical reasons."

The 51-year-old is charged with multiple felonies: three counts of child cruelty and two counts of illegally possessing an assault rifle.
