Suffolk County Sheriff Steven Tompkins filed a motion to dismiss the federal extortion charges levied against him, citing factual inaccuracies by prosecutors.

The motion, filed on Friday, states the indictment "is predicated upon a number of factual infirmities," and that Tompkins, 67, did not engage in any schemes to extort a cannabis executive.

And even if he did, Tompkins's lawyer argues the allegations are insufficient to support the indictments against him.

"Mere allegations of 'fear,' 'pressure,' and 'demands' are not sufficient to establish extortion under color of official right," the motion read.

Tompkins was arrested on Aug. 8 in the Southern District of Florida for two counts of extortion under color of official right, according to United States Attorney Leah Foley
