A BUSINESSMAN has lost his five-year battle to clear a conviction for a deadly crash near Tamworth.

Csaba Somogyi has been fighting to clear his name for negligent driving occasioning the death of his passenger at Borah Creek, between Manilla and Barraba, on March 5, 2020.

The businessman was behind the wheel of the car, which was participating in a Riverina charity rally, when he lost control, slammed into a tree and killed his passenger.

Despite being found guilty in 2023 in Tamworth Local Court of the offence , Somogyi is still fighting the matter in court, two years down the track.

He lodged a conviction and sentence appeal, which was heard in the Sydney Downing Centre District Court.

The district court had previously granted the defence's application to adduce fresh eviden
