PALM SPRINGS, Florida ( WPBF ) -- Despite the suspect and attorney arguing it was an accident, officials have charged an Uber driver with a felony, accusing him of driving off with an infant in the car.

Nathan Velez, 26, is charged with false imprisonment after the Palm Springs Police Department said he drove off with a 6-month-old baby secured in a car seat.

Velez and his attorney have both said it was a mistake and that he didn't know the baby was in the car seat. His attorney also noted that the car seat was covered and his client had no intent to leave with the infant.

The child’s mother, Mikeria Evans, spoke with WPBF 25 News and explained her version of events.
