FRANKLIN COUNTY, Ark. (KNWA/KFTA) — Arkansas Attorney General Tim Griffin's office is seeking to dismiss a lawsuit over the date of the Arkansas Senate District 26 special election.

Attorneys for Gov. Sarah Huckabee Sanders and Arkansas Secretary of State Cole Jester, who are listed as the defendants in the lawsuit, argue that the plaintiff has failed to identify any legal wrongdoing in the governor's scheduling of the election. They also argue that the case should be dismissed on the grounds of sovereign immunity.

The District 26 seat was left vacant by Sen. Gary Stubblefield after his death on Sept. 2. The district includes parts of Franklin, Sebastian, Logan and Scott counties.
