Ohio stores and breweries can resume selling THC drinks and gummies − at least for now.
A Franklin County judge decided Oct. 14 to pause Gov. Mike DeWine's 90-day ban on intoxicating hemp products while a lawsuit plays out. Three businesses sued over DeWine's order , saying he overstepped his authority and caused chaos for the industry.
The retailers are members of the Ohio Healthy Alternatives Association, which advocates for the hemp industry. In affidavits filed with the lawsuit, business owners said the ban would cost them millions of dollars and force store closures or staff firings.
"There's no recovery for going out of business," said Jonathan Secrest, an attorney for the stores. "They’re going out of business because products that were legal last week now are not."
