A Reddit user shared his experience navigating the complex process of changing status from B2 to H-1B . He recently received a Request for Evidence (RFE) under premium processing for his H-1B petition, which requires his approved B2 change of status notice.
Legal Opinions Vary on Responding to RFE
Some immigration lawyers advised him that it is a simple RFE and can be answered without waiting for the B2 COS approval, which may take 3–4 months. “As I have filled everything legally and there is no mistake. Just let the USCIS know there is no further action provided on my B2 COS yet,” he explained.
However, other lawyers cautioned that while H-1B approval is likely, there is a possibility the approval may come via consular processing instead of change of status, which he wants to avoid
