CINCINNATI (WXIX) - The Fountain Square shooting suspect, whose own attorney confirms was seen on surveillance camera firing a gun, was on probation at the time he shot two people on Fountain Square, court records show.

Shaquille Fergson’s attorney, Clyde Bennett II, says the shooting was self-defense.

That aside, court records filed Monday show that Ferguson violated his probation simply by having a gun.

Ferguson is prohibited from having a gun due to a felony conviction in July.

He “was observed in possession of a firearm during a shooting incident that was captured on video,” according to his “Community Control Sanction Violation” filed Monday.
