TRANSYLVANIA COUNTY, N.C. —

District Attorney Andrew Murray ruled that two deputies were justified in using deadly force during an encounter with an armed man in Transylvania County, North Carolina.

On Oct. 21, Murray finished his review of the evidence presented and justified the deputies' use of deadly force.

According to the incident report, on the night of July 5, Rivera was traveling through Pisgah National Forest in his vehicle with a long gun while he was in an emotionally stressed state of mind.

Rivera's ex-girlfriend reported to 911 dispatch that she believed that Rivera was planning to harm himself.
