TRANSYLVANIA COUNTY, N.C. (FOX Carolina) - The District Attorney for North Carolina Prosecutorial District 42 reports deputies with the Transylvania County Sheriff’s Office were justified in their use of deadly force during a deputy-involved shooting in July.

The district attorney said deputies received a call on July 6 from a man’s ex-girlfriend who said she believed he intended to harm himself as he was traveling through Pisgah National Forest with a long gun.

Deputies saw a Mazda Miata around 10 p.m., similar to the man’s vehicle, in a parking space of a closed Pizza Hut before the entrance to the forest and saw Raul Alberto Rivera digging around in it. Rivera raised a long gun, and a deputy fired several rounds at him for his own safety, officials said.
