MCCOOK, Neb. —
The case surrounding the Immigration and Customs Enforcement detention facility in Nebraska is back in court, as some say the facility is unconstitutional.
Thirteen McCook residents and a former state senator filed the lawsuit against Nebraska Gov. Jim Pillen and Rob Jeffreys, the head of the Nebraska Department of Corrections.

They want a judge to rule against the new facility. Part of the lawsuit alleges Pillen does not have the right to repurpose the Work Ethic Camp without approval from the Legislature.
On Friday, in court in Red Willow County, the defense argued the case should be dismissed, saying the plaintiffs do not have standing and the court does not have jurisdiction.
