Q: What does the new law do?
A: The law makes certain DUI offenses a felony, even for first-time offenders. This includes drivers who:
Have a blood alcohol level of 0.15 or higher
Are involved in a crash (injury, death, or property damage above a certain threshold)
Speed 20 mph or more over the limit (or 10 mph+ in a school zone) while impaired.
Drive recklessly (crossing the center line, unsafe passing, driving on wrong side of road, failure to maintain lane)
Evade police
Have a child in the vehicle
An aggravated DUI under the new law can result in ten days in jail.
