A New Hampshire judge has ordered a bond hearing be held “as soon as practicable” for a Haitian national and asylum-seeker held in ICE custody at the federal prison in Berlin, ruling his continued detention violates the due process clause of the Fifth Amendment.
In an order dated Oct. 31, U.S. District Court Judge Joseph N. Laplante directs staff at FCI-Berlin, officials of the U.S. Immigration and Customs Enforcement and U.S. Department of Homeland Security to schedule a bond hearing before an immigration judge for Ralph Bronson Fils-Aime. He has been held in ICE custody since Aug. 22, 2024, because “under these specific facts and circumstances, petitioner’s continued detention violates the Due Process Clause.”
